These terms govern your use of the Peppermynt website and platform. By using either, you agree to them. If you are agreeing on behalf of a hotel, restaurant or other business, you confirm you have the authority to bind it.

The Peppermynt platform and everything in it is owned by Peppermynt, LLC. That includes, without limitation, all software, source code, algorithms, models, artificial intelligence systems, designs, user interfaces, text, graphics, photographs, the peppermynt mark, the wordmark, the name Peppermynt, and the phrase A Sweeter Experience, together with all patents, copyrights, trademarks, trade secrets and other intellectual property rights in any of them, in every jurisdiction.

Nothing on this site or in the platform transfers any of those rights to you. You are granted a limited, revocable, non-exclusive licence to use the platform for its intended purpose, and nothing more.

You may not copy, reproduce, modify, reverse engineer, decompile, scrape, frame, or create derivative works from any part of the platform, nor use it to build a competing product, nor remove or obscure any proprietary notice.

You keep ownership of the content you publish through Peppermynt. You grant Peppermynt a worldwide, royalty-free licence to host, store, reproduce and display that content as necessary to operate the platform and to present it to the guests you have chosen to reach. You are responsible for having the rights to everything you publish.

• Do not use the platform unlawfully, or to infringe anyone’s rights.
• Do not interfere with its security, integrity or availability.
• Do not access it by automated means without our written permission.
• Do not misrepresent who you are or which house you speak for.

Where Peppermynt facilitates payment between a guest and a venue, the venue is the merchant of record and is responsible for the food, the service and the fulfilment of the order. Card processing is handled by our payment processor. Refunds and disputes are settled with the venue, and Peppermynt will assist where it can.

Fees payable by hotels and restaurants are set out in their agreement with Peppermynt.

We work to keep the platform available and resilient, including through multiple connectivity paths, but we do not warrant uninterrupted or error-free operation. We may modify or discontinue features with reasonable notice.

The platform is provided as is, without warranties of any kind to the fullest extent the law allows. Peppermynt is not liable for indirect, incidental, special or consequential damages, or for lost profits or lost data. Our total liability for any claim is limited to the amounts you paid us in the twelve months before the claim arose.

Nothing here excludes liability that cannot lawfully be excluded.

You agree to indemnify Peppermynt against claims arising from your use of the platform, your content, or your breach of these terms.

We may suspend or end access if these terms are breached. The provisions on intellectual property, disclaimers, liability and indemnity survive termination.

These terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles, and the state and federal courts located there have exclusive jurisdiction.
